By downloading, installing, or using Dear Beary, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app and uninstall it from your device.

Description of Dear Beary

Dear Beary is a digital diary application that provides:

• Voice-to-text diary entries: Using Vosk open-source speech recognition
• Private local storage: All entries stored only on your device
• Offline functionality: No internet connection required
• Bear-themed interface: Including optional bear roar notification sounds
• Reminder notifications: Optional diary writing reminders

License to Use Dear Beary

We grant you a limited, non-exclusive, non-transferable license to use Dear Beary for personal diary and journaling purposes. You may not:

• Reverse engineer, decompile, or disassemble the app
• Remove or modify any copyright notices or branding
• Use the app for commercial diary services
• Distribute, sell, or sublicense the app to others
• Extract or reuse the bear roar sound or other audio assets
• Use the app in any way that violates applicable laws

Voice Input and Privacy

Dear Beary's voice input feature:

• Processes audio locally: Using Vosk technology on your device only
• Does not record or store audio: Voice is converted to text immediately
• No cloud processing: Your voice never leaves your device
• User control: You can choose when to use voice input

Voice Input Risks: While we use secure local processing, you use voice input at your own risk. Ensure you're in a private environment when using voice features for sensitive personal content.

Data Storage and Backup Responsibility

Local Storage Only: All diary entries are stored locally on your device. This means:

• We cannot backup your entries for you
• If you lose your device or data, your entries may be permanently lost
• Uninstalling the app may delete all your entries
• Device resets or failures may result in data loss

Your Backup Responsibility: You are responsible for backing up important diary entries using your device's backup features or manually copying important content.

Disclaimer of Warranties

Dear Beary is provided "AS IS" without any warranties, including but not limited to:

• Warranties that voice recognition will be 100% accurate
• Warranties that the app will preserve all your diary entries
• Warranties that reminders and notifications will always work
• Warranties of merchantability or fitness for therapeutic purposes
• Warranties that the app will be error-free or uninterrupted

Voice Recognition Accuracy: Vosk voice-to-text conversion may not be 100% accurate. Always review converted text before saving entries.

Limitation of Liability

Maximum Protection for Independent Developer: To the fullest extent permitted by law, CRISPPIE STUDIO shall not be liable for:

• Lost diary entries or personal content due to app malfunction, device issues, or user error
• Emotional distress from lost personal memories or diary content
• Privacy breaches if your device is compromised by third parties
• Voice recognition errors that result in incorrect text conversion
• Missed reminders that result in lost diary habits or memories
• Any damages exceeding $10 USD or the amount you paid for the app

User Responsibilities

As a Dear Beary user, you agree to:

• Backup important entries: We cannot recover lost diary data
• Keep your device secure: Use device locks and security features
• Use appropriate content: Don't write illegal or harmful content in entries
• Understand voice risks: Use voice input in private environments
• Review voice transcriptions: Check text accuracy before saving
• Report bugs responsibly: Help us improve the app through feedback

Third-Party Audio Content

Dear Beary includes a bear roar notification sound from Pixabay:

• Source: Universfield on Pixabay (Ukrainian audio project)
• License: Used under Pixabay Content License
• Usage: For notification purposes only within the app
• Restrictions: You may not extract or reuse this audio outside the app

• Limited resources compared to large corporations
• Support response times may vary
